Dubai Jobs : Guide to Work and Careers in Dubai UAE. Finding the perfect job in Dubai can offer its own set of unique challenges. The UAE has not been immune to the global economic crisis and competition for available jobs is stiff. In addition, labor laws in the UAE can be confusing and seem to be in a constant flux. By educating themselves on the basics of UAE labor law, employees can avoid many common pitfalls that may arise during their time working in Dubai UAE.

Rights that job seekers take for granted in their home country may not necessarily apply in Dubai. For example, there are no anti-discrimination laws in effect and employers can request anything from a certain nationality or age group to a certain appearance. There is also no minimum wage. An employee’s nationality is often a determining factor in the amount of pay offered, with Europeans and Arabs on the higher end of the scale and Asians on the lower end. Because changing jobs in Dubai is not a straightforward process, it is a common (although illegal) practice for some employers to hold employee passports as security against absconding.

Dubai Jobs : Guide to Work, Jobs and Careers in Dubai UAE. An expatriate’s right to live and work in the UAE is tied to their sponsor, in this case the employer. Once a job seeker is hired, an employment contract will be signed. The contract is either fixed term or unlimited term. A fixed term contract means that there is a specified start date and end date. The contract cannot exceed three years, but can be renewed. Unlimited term contracts list a start date but are open-ended. They may be terminated by mutual consent or by either party giving 30 days notice. A new employee may undergo a probationary period of not more than six months. During this time the employee can be dismissed without reason or notice and he or she will not be entitled to any end of service benefits. Contracts may also include a competitive clause which states an employee cannot work for a competitor for up to two years.

Once a contract is signed the employee is legally bound to fulfill it. While laws regarding sponsorship have eased, allowing employees some movement between jobs if certain conditions are fulfilled, it still can be a challenging process. In most cases, in order to transfer to a new job the employee must complete one full year of service at their current position and obtain an NOC (No Objection Certificate) from their current employer. The NOC states that the employer releases the employee from any contractual obligations. If an employee’s work permit is cancelled without the NOC, a six month ban will be issued against the employee.

This means that while they can reenter the UAE on a visit visa during the ban, they will not be issued a new work permit for six months. There are certain categories of workers who are exempt from these rules, including employees of government departments and Free Zone areas (such as Dubai Media City, Knowledge Village, and Internet City). Free Zone workers are not under an individual company’s sponsorship, but under the sponsorship of the entire Free Zone area itself. As such, they can transfer to a new job within the same Free Zone without an NOC. Employees sponsored by their spouses also have greater freedom of movement between jobs.

While Dubai offers an exciting, multi-cultural work environment coupled with tax free income, employees do need to be aware of how job regulations can affect them. The government of Dubai is currently reviewing labor laws, particularly the six month ban rule, in light of the current global economy. Changes giving workers more rights and greater flexibility to move from one job to another may be on the horizon.

Working Conditions in Dubai

If you’re used to western, staff friendly working conditions, employment in Dubai may comes as something of a shock. With so much cheap labor from Asia, certain jobs are, in effect, closed to westerners, including many trade occupations, such as carpenters and plumber; petrol pump attendants, shop assistants, construction workers and waiters and waitresses.

There are several crucial points with which employee should need to be aware:

  1. Once the employee sign a contract (which may be fixed or open), the company for which you work has to sponsor you. A part of the process of acquiring sponsorship and obtaining employee’s residence visa, you must provide a blood sample, which is tested for communicable diseases. If your sample shows any indications of diseases, you’ll be deported straight away.
  2. If you are working with a respectable company you have benefits whether you need to rent a villa or apartment, want a bank loan to purchase a car, want to subscribe to some mobile – phone services or obtain a liquor license; but what happens if you don’t work with reputable company.
  3. The maximum working hours for the private sectors are officially eight/day, or 48 hours per six day week. Ten hour days over a five- day week are common, with no overtime paid and, in some cases, no time off in lieu of overtime worked either.
  4. There seems to be concept of fairness when working in Dubai; the color of employee’s passport tends to decide the level of job for which you can apply. It’s the norm, e.g., for your job adverts to stipulate the nationality and gender of candidates
  5. Salaries are also differs according to nationalities; e.g. a hotel worker from the Philippines as a waiter with two years experience, she can earned dhs 900/month, on the other hand a Romanian colleague doing the same job, earned dhs 1,300/month

Visas For Dubai

Visas For Dubai : Visas and Sponsorship for Dubai. This was already a minefield, at least for the processing, but now Dubai Immigration and Naturalisation, has devised a list of multiple categories to encompass all types of travellers. The reason behind it is that the ‘visit visa’, which was given on entry for certain countries or bought with the ticket from others e.g. The Philippines, was being abused. People were entering on a visit visa and after the 30 days, going on what is commonly known as a visa run. This is the exercise of exiting the country to come back in on a new 30 day visit visa… and so it goes on.

This would then fly in the face of employment bans which is a very emotive subject. The law still states that if anybody leaves their place of employment within the first year, they are liable for an immediate 6 month labour ban. This is purely to do with employment and is separate from an Immigration ban, which is 1 year in length and normally issued for misdemeanours of a serious nature like theft or other punishable offences.

To exploit the 6 month labour ban, many workers would continue working on a ‘ban’, and just exit the country twice, until the ban was over, and then they could go onto the sponsorship of their new employer.

At this point, it’s safe to say that most managerial roles do not initiate a ban if the employee leaves, and there are many great corporations who do not ban staff of any level. This is refreshing, as there are some companies who abuse the rule and threaten to ban people if the resign or ask for a promotion/pay raise.

The contract states the role and most commonly for lower paid staff, the duration of the contract. If the employee breaks that contract at anytime, the are liable for a ban.

The NOC (No Objection Certificate) : The NOC is what is required to ‘safely’ transfer from one job to another. If you choose to leave a company within the term of your contract, and the employer is happy to let you go, they still have to produce an NOC. This is actually a brief letter stating the employees name and passport number, the company’s details, or employers details (if working for an individual) and clearly wording their agreement to let the employee transfer without a ban to the next emmployer. The employee is then said to have obtained a ‘release’. This letter is shown during the visa process, and as long as an NOC is obtained, there is no ban applicable.

The Visa Process : The visa process can be painful, therefore the job is done by a company ‘PRO’ or public relations officer (but not in the sense of an advertising or marketing role). If it is an individual applying for a visa for a housekeeper, driver etc, there are ‘company formation’ companies who will do this for a fee. The very brave can go to immigration themselves, but this can be a very long and arduous process as you are passed from one desk to another; to get a signature, pay a deposit, get a translation typed or wait for a stamp. I recommend wholeheartedly using a start-up company, who use their regular contacts at immigration, while you have a coffee!

It is also necessary for the individual who’s having a visa processed, to have to exit the country to go from visit visa status to working visa status. Previously this could be waived (for some nationalities) if you paid a fee. In the past, it was not necessary to fly back to your country of origin, but the now more stringent laws are reintroducing this. At the time of writing this, it is still not clear if all nationalities have to fly to their home country i.e. British, EU and American citizens. Either way, for the visa to be processed, it is necesssary to exit Dubai as a forrmality, to then return under your new status. This is known as a ‘visa run’. You fly out (most commonly) to Qatar (around 45 minutes duration), enter the terminal building, do not pass through immigration but go through transit, enter the departure lounge, and come straight back on the same plane which brought you out. It was also possible to drive to Hatta (another Emirate within the UAE) and have your passport stamped there – although the point behind that is that you should be driving to the Omani border, but that didn’t always seem to be enforced.

Medical Test : It is a pre-requisite to have a medical and pass it, before your visa is finally processed. This entails a blood test and chest X-Ray. If you are found to be HIV+ or have Hepatitis C, you will be immediately refused and deported. This is under discussion, but as yet (September 2008) the rule remains. It is also imperative to have valid medical insurance to enter the country, even on a tourist visa.

Visa requirements for entering Dubai vary greatly between different nationalities and it is always advised to check regulations before traveling. Currently, every nationality entering the UAE needs a visa except citizens of GCC countries (Gulf Cooperation Council: Bahrain, Kuwait, Oman, Qatar and Saudi Arabia) expatriate residents of the GCC (certain nationalities and professions) and British citizens with the right of abode in the UK. The following citizens of Europe also receive visas on arrival citizens of : Andorra, Austria, Belgium, Denmark, Finland, France, Germany, Greece, Iceland, Ireland, Italy, Liechtenstein, Luxembourg, Monaco, the Netherlands, Norway, Portugal, San Marino, Spain, Sweden, Switzerland, and the Vatican.

In addition, nationals from Australia, Brunei, Hong Kong, Japan, Malaysia, New Zealand, Singapore and South Korea in Asia, as well as those from the United States of America and Canada also now receive Visas on arrival.

GCC nationals can stay more or less as long they like. British citizens can stay for a month and then apply for a visa for a further two months. European, American, South African and Australian citizens may obtain a visit visa from the UAE embassy in their respective countries before departure. Please note that Israelis and travelers whose Passports bear Israeli stamps will be denied a visa. For all other nationalities, a visa must be applied for before the visitor enters the country either through their respective embassy, a local UAE sponsor or a local hotel.

TOURIST VISA : This visa is issued through tourist companies and it is valid for 30 days. It You cannot renew it or extend it. If the Visa holder of the tourist visa stays more than the 30 days, that person has to pay a fine per day plus some charges are for an out pass.

VISIT VISA : Visa is issued through Dubai Naturalisation and Residency Department. It is stamped for 30 days validity but it is valid for 60 days and can be extended for 30 more days by paying some amount. The extension needs to be done before the 60th day. If the visitor stay more than 60 days or more than 90 days (after the extension) they will have to pay a fine per day plus some charges for an out pass. Certain passport holders can enter the UAE without obtaining a visit visa prior to arrival and stay up to 30 days.

Dubai Visit Visa

Suppose you are planning on a visit to Dubai, either for holidays or work, it is a requirement that you have in possession a valid visa. Moreover, the steps towards acquiring a visa vary depending on an individual’s Nationality. Generally, it is easy to have your visa processed, since it takes 72 hours for a normal application, and for urgent cases, it can be done in one day. The process is hassle free, provided you have all documents required.

To start, members of the following Nationalities should have no problems getting visas to Dubai, since they can easily be granted one on arrival at Dubai Airport. The Nationalities are as follows: GCC Nationals who are composed of Oman, Bahrain, Saudi Arabia, and Kuwait. The others include; Germany, France, Luxembourg, Italy, Norway, Finland, Switzerland, Ireland, Portugal, Belgium, Greece, Liechtenstein, Spain, Iceland, San Marino, Vatican City, and Andorra. Lastly, there is the USA, UK, Canada, Australia, New Zealand, Malaysia, Brunei, Japan, and Hong Kong. However, you must ensure you check for updates, since the list of countries is updated by the Dubai government. It would be wise to establish contact with the Dubai government website.

If your Nationality doesn’t fall on the above list, please make sure your passport is obtained from a sponsor. This can be done in three ways. Firstly, you can get sponsorship from an individual who possesses a Dubai residence visa, and has an income exceeding more than AED 4000/month. Secondly, it can be done by a travel agent or hotel, and lastly, through a company that is already operating in Dubai. Additionally, for the sponsorship to go through, the sponsor should be in a position to submit your visa application accompanied by the relevant visa fee. Thus, a Dubai visit visa is only valid for 55 days from the time the visitor enters Dubai/UAE. However, it is only renewable for an additional one month.

Other ways of getting a visit Visa to Dubai include the following: You may opt to fly with Emirates Airlines. Visitors flying Emirates Airlines are eligible to send visa applications to the Dubai Visa Processing Centres (DVPC). However, this is limited to some countries. For more information on this, contact your nearest Emirates office. It is also possible to be granted a visa if you are traveling during a major festival period. The restrictions in place at such times are loosened a bit. Such festival periods include the Dubai shopping festival. Another option is staying in a major hotel, since majority of these major hotels sponsor their visitors. If a visitor is willing to stay in the hotel for a little longer, then the hotel will organize on how a visa will be

Applying for a residence visa

In order to get a work permit, the employee must first be granted a residence visa, which is typically valid for a period of three years. There are different types of residence visas. The documents required for a residence visa include:

  • An application form, completely filled out
  • Several passport-size photographs
  • Employee’s original passport with a copy
  • Copy of a valid company card
  • Valid commercial license of the company
  • Application fee
  • Valid health certificate
  • Entry permit issued by the Ministry of Labor

Although a residence visa is not the same as a labor card, the employer usually applies for the visa on behalf of the employee.

Medical Requirements for Residence Visa

A valid health certificate is required for the issuance of a residence permit; this requires applicants to undergo a health check at any government hospital or medical clinic. The test must be conducted once the applicant is in the country; tests from outside the country are not accepted.

The medical check includes a chest X-ray and blood tests to check for certain communicable diseases such as HIV/AIDS, leprosy, Hepatitis and tuberculosis. Positive results on any of these tests will result in a denial of the residence visa and immediate deportation. At present there is no appeals process for this in Dubai.

Procedure for Entry Permits and Work Permits

  • The first step towards getting your work permit is to get approval from the Ministry of Labor. The employer will apply for this on behalf of the employee. If the approval is for application in any of the free zones, approval must be granted before the employee enters the UAE. During this approval process, the Ministry of labor usually bases its decision by checking that there are no unemployed UAE citizens who are able to perform the relevant job.
  • Upon receipt of approval, the Ministry issues an Entry Permit visa (also known as a pink visa) which allows applicants to legally enter the UAE. This permit is valid for 2 months from the date of issue and allows the holder to remain in the UAE for a period of 30 days, extendable twice.
  • After the employee enters the country, the employer then begins the application process for the labor card. For free zone employment an ID card will be issued; both IDs and labor cards are typically valid for 2 years. Once the employee enters the country, he has sixty days in which to complete all the formalities required to get a residence visa. It is advisable to get these procedures done as soon as possible rather than waiting till the last moment.
  • The employee then needs to go to the Emirates ID service center after getting the relevant form typed up at any typing center. Original valid passport and valid entry permit are required.
  • The employer can now apply to the Immigration authorities for the residence visa; the employee needs to go to any of the government hospitals for their medical fitness tests. (See section on Medical requirements for Residence Visas). Certain professions also require employees to provide relevant educational qualifications which will be authenticated by the UAE embassy in your home country as well as the Ministry of Foreign Affairs in the UAE.
  • Once the employer has the results of the medical fitness test, he can then go to the Department of Naturalization and Residency Dubai (DNRD) with all the supporting documents and the visa can be stamped on the employee’s passport.

  • Residency Visa
  • Valid Passport (minimum six month validity required)
  • Valid health certificate
  • Three copies of the employment contract – one for the employer, one for the employee and one for the Ministry of Labor
  • Education certificates and other evidence of professional qualifications
  • Sponsoring company’s valid trade license
